Since the transaction constitutes the supply of a service within the meaning of Law No. 6502, the party identified above holds the capacity of PROVIDER; it is referred to hereinafter simply as the SELLER/PROVIDER.
BUYER: The name, contact and invoicing details you provide during the reservation are taken as the BUYER's details. This information appears in the booking summary displayed on screen before the payment step and in your booking confirmation document.
2. Subject and Scope of the Contract
The SELLER/PROVIDER is a travel agency operating under Law No. 1618 on Travel Agencies and the Association of Travel Agencies (Seyahat Acentaları ve Seyahat Acentaları Birliği Kanunu) and acts as an intermediary in the sale of flight tickets and accommodation services. The subject of this contract is the sale and performance of the flight and/or accommodation service selected and paid for electronically by the BUYER, together with the rights and obligations of the parties in that respect. The service itself is performed by the relevant airline or accommodation establishment and is subject to that supplier's own conditions of carriage and accommodation.
This contract covers flight ticket and accommodation sales only. Services in the nature of package tours, as well as transfer services, are subject to their own legislation and to separate contractual terms, and fall outside the scope of this contract.
3. Essential Characteristics of the Service
The essential characteristics of the service you purchase are set out in the booking summary displayed on screen before the payment step. For flight services, the route, dates and times, airline, fare type and baggage allowance are stated; for accommodation services, the property, room type, board basis and the check-in and check-out dates are stated. The number of passengers or guests and their names are shown in the same summary. The booking summary and the confirmation document delivered to you (electronic ticket or voucher) form an integral annex to this contract.
4. Total Price, Currency and Payment
The total price of the service including all taxes, and the currency of that price, are displayed on screen at the payment step. The price in force is the price shown on screen at the moment of payment. Prices may change until payment is completed, depending on supplier conditions and exchange rates. Payment is collected in advance and in a single instalment by bank or credit card through 3D Secure verification. Your card details are not stored by the SELLER/PROVIDER; collection is carried out through the infrastructure of the authorised payment institution. The reservation is not confirmed until payment has been approved.
5. Performance and Delivery
Booking documents are delivered electronically. Once payment has been approved and the reservation has been confirmed by the supplier, the electronic ticket, voucher or booking confirmation is sent to the e-mail address notified by the BUYER and can be viewed on the booking enquiry screen. If the document does not reach you, please contact our support channels. The service itself is provided by the relevant airline or accommodation establishment on the dates and under the conditions stated in the document.
6. Right of Withdrawal
For the purposes of the right of withdrawal, flight and accommodation services are assessed on different grounds, and in neither case does a right of withdrawal exist.
- Flight services: Passenger transport services are excluded from the scope of application of the Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği). Accordingly, no right of withdrawal arises for flight tickets within the meaning of the Regulation; rights relating to the ticket are governed by the relevant airline's conditions of carriage and by aviation legislation.
- Accommodation services: Contracts for accommodation, entertainment or leisure purposes whose performance is agreed for a specific date or period are listed among the exceptions to the right of withdrawal in the Regulation. For this reason, the right of withdrawal cannot be exercised for accommodation reservations.
Your cancellation and change requests are therefore assessed not under the right of withdrawal, but within the framework of the supplier rules explained in Article 7 below. This forms part of the preliminary information provided to you before payment.
7. Cancellation, Change and Refund Conditions
Cancellation and change conditions vary according to the fare purchased and the policy of the relevant supplier; the SELLER/PROVIDER has no authority to determine these conditions. The cancellation conditions specific to your reservation are stated in your booking summary and in your confirmation document. For comprehensive information, please review our Cancellation Policy page.
- For reservations granting a free cancellation right, the price is refunded where the cancellation is made by the last cancellation date stated.
- For partially refundable fares, a deduction may be applied in accordance with the supplier's policy.
- For non-refundable fares, no refund of the price is made in the event of cancellation.
- For cancellations made at the BUYER's request, approved refunds are processed to the card used for payment within 5-14 business days; the time taken by the bank to credit the account falls outside this period.
- In the case of cancellations originating from the SELLER/PROVIDER or from the supplier, the entire amount collected is refunded to the BUYER within fourteen days at the latest, running from the date on which it becomes clear that performance of the service has become impossible.
8. Obligations of the BUYER
- The BUYER is responsible for ensuring that the names given in the reservation are identical to those on the passport or identity document; correction fees and travel disruptions arising from an incorrect name are borne by the BUYER.
- Passport validity, visas, transit visas and compliance with the health requirements of the destination country are the passenger's responsibility.
- Completing check-in on time and arriving at the flight and at the accommodation establishment at the stated times are the BUYER's responsibility.
- Contact details must be kept accurate and up to date; confirmation documents and change notifications are sent using this information.
- Payment must be made with a card belonging to the BUYER or which the BUYER is authorised to use.
9. Force Majeure
Events arising beyond the control of the parties and not reasonably foreseeable (natural disaster, state of emergency, strike, closure of airspace, flight cancellation or closure of a property originating from the supplier, epidemic disease and similar circumstances) are deemed force majeure. In such cases the SELLER/PROVIDER offers the BUYER the options of a full refund, a change of date or an alternative service within the framework applied by the supplier, and follows the process through. Where a refund of the price is required, the fourteen-day period set out in Article 7 applies. The parties cannot be held liable to one another for obligations that cannot be performed for the duration of the force majeure event.
10. Protection of Personal Data
The personal data you share in connection with your reservation is processed within the framework of the Personal Data Protection Law No. 6698 (Kişisel Verilerin Korunması Kanunu). Detailed information on the purposes and legal grounds of processing, on transfers to suppliers and competent authorities, and on your rights under the Law can be found on our Personal Data Protection Notice and Privacy Policy pages.
11. Resolution of Disputes
The laws of the Republic of Türkiye apply to disputes arising from this contract. Within the monetary limits announced each year by the Ministry of Trade (Ticaret Bakanlığı), the BUYER may apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) at their place of residence or at the place where the transaction was carried out, and, for disputes exceeding those limits, to the Consumer Courts (Tüketici Mahkemeleri). Complaints concerning travel agency activities may additionally be submitted to the Ministry of Culture and Tourism (Kültür ve Turizm Bakanlığı) and to the Association of Turkish Travel Agencies (TÜRSAB).
12. Entry into Force and Electronic Approval
Preliminary information has been provided by means of the booking summary displayed on screen before the payment step and by the text of this contract. The contract is deemed to be concluded once the BUYER confirms electronically, at the payment step, that they have read and accepted this contract; the date and time of approval, a copy of the approved text and the booking reference are recorded. The contract enters into force at the moment of electronic approval. The text you approved is recorded together with the date and time of approval and is provided to you upon request; the text published on this page is the current version and may have been amended subsequently.
